1. competition and organizer

The competition is organized by the Environmental Working Group of the Student Council of the TU Bergakademie Freiberg (hereinafter referred to as the “Organizer”) in cooperation with Department 5 of the TU Bergakademie Freiberg, the University Library “Georgius Agricola” and the Freiberg Student Union (all three hereinafter referred to as “Cooperation Partners”).

Participation is exclusively subject to the following conditions of participation.

2. Participation

a) Any natural person aged 18 or over who is resident in Germany and enrolled as a student or employed at TU Bergakademie Freiberg is eligible to participate. Excluded from participation are the jury members of the organizer.

b) Multiple participation of a person in the competition is permitted. A participant may not win and/or be exhibited in any (0)/one (1) or more (1+) categories, but only once per category. This means that only one picture can be submitted per category.

c) Participation in the competition is only possible between 23.06.2025 and 20.07.2025.

d) Participation is completely free of charge and does not require the purchase of any goods or services.

e) To participate in the competition, it is necessary to send in at least one picture of a flowering plant from areas on the campus. The submission is made via the corresponding LimeSurvey survey (service provider is the URZ of TUBAF):

Images can also be submitted by e-mail to ag-umwelt[at]stura.tu-freiberg.de via a link in the survey. Incorrect information or incomplete entries will not be considered. The organizer cannot be held responsible for late or incomplete entries.

f) By participating in the competition, the participant agrees to these conditions of participation and grants the organizer and/or its cooperation partners the simple rights of use for the exhibition, a possible online publication and, if applicable, press releases (see point 6).

3. implementation and processing

a) The following prizes are to be won under the associated conditions. In addition, the best entries will be selected by a jury (representatives of the organizer and the cooperation partners) and exhibited in the Agricola Hall of the University Library. The winners of the prizes will be determined by the same jury. In addition, voting in the community vote category will be carried out via another survey at .

The following prize categories are possible:

  • 1 main prize (1st place) per category and the exhibition in the Agricola Hall of the University Library
  • 2 secondary prizes (2nd and 3rd place), 2nd place may also be exhibited
  • Main and secondary prizes consist of items from the TUBAF Uni Shop

Participation is possible in the following competition categories (valid for the competition from 23.06.2025 to 20.07.2025):

  • Insect on plant
  • Photo of a meadow plant
  • Community vote (both categories i or ii possible)

b) The campaign starts on 23.06.2025 and ends on 20.07.2025

c) The winners in the individual categories as well as the exhibitors will be selected by the jury and notified by e-mail no later than 5 days after the end of the competition; they must then confirm the claiming of the prize(s) and (if necessary) the renewed consent to the exhibition within 4 days of notification of the prize using the contact details provided in this notification. If this confirmation is not received, the prize will be awarded to other participants in the competition.

d) The jury will vote by relative majority in each category. The jury consists of representatives of the organizer and the cooperation partners and is made up of at least 4 people. In the event of a tie, the winners of a category will be determined verbally and argumentatively from the leading entries. Any information that can be derived from the personal data (see point 7), such as origin, age, sexual orientation or gender and membership of a status group of the university or other social groups, does not play a role in the decision-making process. The community voting will take place during the same period as the jury voting by means of a LimeSurvey poll or via instagram.

e) For multiple entries: Each participant may receive no (0), one (1) or several (1+) prizes, but only one (1) per category. In addition, the participant may be awarded a maximum of one (0 or 1) per category.

f) The entitlement to the prize cannot be assigned and is not transferable; furthermore, the prize cannot be paid out, amended or changed. If the prize cannot be made available for any reason whatsoever, the organizer reserves the right to award a substitute prize of equal value.

a) In the event of a breach of these conditions of participation, the organizer reserves the right to exclude participants from the competition.

b) Furthermore, the organizer reserves the right to exclude participants who use unauthorized aids or otherwise gain advantages through manipulation. c) The submission of illegal content, such as insults, prohibited political propaganda, pornography or similar, will also be excluded.

5. Premature termination or abandonment of the competition

The organizer is entitled to terminate, suspend or modify the competition prematurely if unforeseen circumstances arise which are beyond the organizer’s control and which make the original implementation difficult or unreasonable for the organizer. These include, but are not limited to, unauthorized intervention by third parties, technical problems with hardware and software that are beyond the organizer’s control, as well as legal violations that are directly related to the implementation of the competition, in particular manipulative intervention in the course of the competition.

6. Publication/exhibition of the submitted entries, copyright and personal rights

The entries submitted during the competition may be published on the official Instagram channels and/or websites of the organizer or the cooperation partners and exhibited for a limited time in the Agricola Hall of the University Library. In addition, press releases on the project may contain contributions.

The copyright lies with the participants themselves. They grant the organizer and/or the cooperation partners a simple, non-exclusive and perpetual right to use the entries free of charge for publication, exhibition and public access as part of the competition and public relations work. In return, the organizer and its cooperation partners undertake to appropriately indicate the author of the work at all times.

Personal data of the creator (point 7) will be used for the purpose of indicating the copyright, unless otherwise stated in the survey form. This concerns the full name (or alternatively the designation Anonymous) and the status (student, employee). In addition, the date of the photo may be published for better classification in the context of the growing season.

Personal rights: The participants also assure that they have obtained the consent of any persons depicted and recognizable on the entries for publication as part of the competition and the associated public relations work.

If an entry is not to be published, this must be communicated when the entry is submitted. Consent can be withdrawn at any time by e-mail without giving reasons.

The organizer collects and uses the personal data of the participants exclusively within the legally permissible framework.

If you take part in the organizer’s competition, the following personal data will be collected by the organizer

The organizer will delete the winner’s data when it is no longer required for these purposes. This is usually the case when the exhibition and the agreement on the whereabouts of the poster have been made.

Of course, every participant has the right to request information about the personal data stored by the organizer at any time in accordance with Art. 15 GDPR. The same applies to the deletion of the corresponding data by the organizer in accordance with Art. 17 GDPR, as well as the correction in accordance with Art. 16 GDPR and blocking of the data in accordance with § 18 GDPR.

9. Instagram

a) The competition is in no way connected to Instagram and is in no way sponsored, supported or organized by Instagram or Meta Platforms, Inc.; the participant shall not have any claims against Instagram or Meta Platforms, Inc.

b) Inquiries and comments by the Participants must be addressed exclusively to the Organizer and not to Meta Platforms, Inc.

10. Liability of the organizer

The following exclusions and limitations of liability apply to the organizer’s liability for damages, notwithstanding the other statutory requirements for claims:

a) The organizer assumes no liability for damages incurred by participants in connection with participation in the competition or visiting the exhibition, unless they are based on intent or gross negligence on the part of the organizer.

b) Technical problems that lead to non-participation or loss of data are not the responsibility of the organizer.

11. final provisions

a) Legal recourse is excluded.

b) The law of the Federal Republic of Germany shall apply to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG), which has been incorporated into German law.
